These Terms of Use govern access to and use of the HidroAlerta24 website (hereinafter, "the Service"). By accessing and using the Service, the user fully accepts these terms. If you disagree with any of them, please do not use the website.
1. Acceptance of terms
Access to and use of HidroAlerta24 implies full and unreserved acceptance of these Terms of Use, as well as the Legal Notice, the Privacy Policy, and the Cookie Policy.
HidroAlerta24 reserves the right to modify these terms at any time. Continued use of the Service after publication of changes constitutes acceptance of the modified terms.
2. Description of service
HidroAlerta24 is an informational early-warning system for floods that offers:
- Real-time visualization of meteorological and hydrological data on an interactive map.
- Flood alerts based on data from multiple public sources.
- Information on reservoir status, river levels, and flood forecasts.
- Email notifications for subscribed users.
- Informational blog, glossary, and FAQ on hydrology and floods.
All information provided by HidroAlerta24 is indicative and informational in nature and does not in any case replace the competent official agencies.
3. Permitted use
The user agrees to use the Service diligently, in accordance with the law, these Terms of Use, and good faith. Use of the Service is authorized for:
- Personal and informational use: Consulting meteorological and hydrological data for personal information.
- Educational use: Using the information for learning or outreach purposes, always citing the source.
- Subscription to alerts: Receiving email notifications about risk situations.
Professional or commercial use of the data shown on HidroAlerta24 is not permitted without prior authorization from the operator.
4. Limitation of liability
The user acknowledges and accepts that:
- The data shown on HidroAlerta24 may contain errors, inaccuracies, or delays due to the nature of the external data sources used.
- HidroAlerta24 does not replace official agencies (AEMET, Civil Protection, Hydrographic Confederations) regarding meteorological or hydrological alerts.
- Uninterrupted availability is not guaranteed. Interruptions may occur due to maintenance, technical failures, problems with data sources, or force-majeure events.
- The HidroAlerta24 operator shall not be liable for direct or indirect damages, losses, or harm of any nature arising from use or inability to use the Service.
- Decisions made by the user based on HidroAlerta24 information are the user's sole responsibility.
IMPORTANT: In any flood emergency, always follow the instructions of Civil Protection and consult the official alerts from AEMET. Call 112 in case of emergency.
5. Prohibited conduct
The following are expressly prohibited:
- Scraping and automated extraction: Using bots, spiders, scrapers, or other automated tools to extract data from the Service in a massive or systematic manner.
- Unauthorized commercial use: Redistributing, selling, sublicensing, or commercially exploiting the data, content, or features of the Service without the operator's express authorization.
- Mass redistribution: Copying, replicating, or redistributing the Service's content at scale, whether manually or automatically.
- System overload: Performing deliberate actions that may overload the Service's infrastructure, including denial-of-service (DDoS) attacks, mass requests, or any form of abuse of server resources.
- Reverse engineering: Decompiling, disassembling, or attempting to obtain the Service's source code through reverse engineering, except in cases expressly permitted by law.
- Impersonation: Impersonating HidroAlerta24 or implying an official association with the Service without authorization.
- Unlawful use: Using the Service for any purpose contrary to current law, public order, or third-party rights.
Failure to comply with these prohibitions may result in blocking access to the Service without prior notice, as well as any legal action that may apply.
6. Intellectual property
The source code, visual design, user interface, logos, and original content of HidroAlerta24 are protected by applicable intellectual and industrial property laws and are owned by the Service operator.
The meteorological and hydrological data shown comes from public sources and third-party services (AEMET, MITECO, Open-Meteo, OpenWeatherMap, RainViewer, Blitzortung), each subject to its own licenses and terms of use. HidroAlerta24 respects and complies with the terms of use of each data provider.
7. Subscriptions and notifications
Users may voluntarily subscribe to the HidroAlerta24 email alert system. Regarding subscriptions:
- Subscription requires providing a valid email address.
- The user can unsubscribe at any time, using the link provided in each alert email or by contacting [email protected].
- HidroAlerta24 does not guarantee delivery of all notifications, since this depends on external factors such as the user's email provider.
- Notifications are informational in nature and do not replace official agency warnings.
8. Modifications to the service and terms
HidroAlerta24 reserves the right to:
- Modify, suspend, or discontinue the Service in whole or in part at any time, with or without prior notice.
- Update these Terms of Use. The date of the latest update will be indicated at the top of this page.
- Modify the features, data sources, or technical characteristics of the Service.
Users are advised to review these Terms of Use periodically.
9. Severability
If any clause of these Terms of Use is declared null or invalid by a competent court, such nullity shall not affect the validity of the remaining clauses, which shall remain in full force and effect. The clause declared null shall be replaced by another that, while valid, reflects as closely as possible the intention of the parties.
10. Applicable law and jurisdiction
These Terms of Use are governed by current Spanish law. For the resolution of any dispute that may arise in connection with access to or use of the Service, the parties submit to the jurisdiction of the competent courts in accordance with applicable procedural law.
